Co-Parenting Companion Terms, Conditions, Consent, Waiver & Release

  1. Nature of Service

  1. Co-Parenting Companion is a high-quality, evidence-based Co-parenting Coaching service to coach separated co-parents to have a collaborative, healthy co-parenting relationship.
  2. Co-Parenting Companion is operated by Tiffany Rochester. While Tiffany Rochester is a registered psychologist, you acknowledge that you are participating in a coaching service, not a psychology service. You will not receive psychological treatment, diagnosis, or therapy.
  3. As this is not a clinical service, Medicare and Health Fund rebates do not apply.
  4. To avoid conflicts of interest and dual relationships:
  1. Clients of Tiffany Rochester’s psychology practice (The Same Mountain) cannot join Co-Parenting Companion programs.
  2. Clients of Co-Parenting Companion cannot become psychology clients of Tiffany Rochester.
  1. Structure of Co-Parenting Companion

  1. Co-Parent Coaching is a collaborative process guided by evidence-based practices. We encourage you to learn as much as possible about our process and services before commencing. You can read more about our approach here: https://coparentingcompanion.au/
  2. Co-Parenting Companion offers different levels of coaching according to Client needs and preferences. Depending on your circumstances, you may participate in our group courses, or our 1:1 and 1:2 Consultations and Packages.
  1. Terms of Engagement

  1. Participation is voluntary. We do not provide services mandated by Court Orders, nor where the participant is unwilling.
  2. Co-Parenting Companion is committed to providing a culturally safe environment.
  1. We recognise the unique status of Aboriginal and Torres Strait Islander Peoples as the First Australians and actively work to ensure our services are free of racism and bias. We engage in ongoing reflection to understand how our own culture and beliefs may influence our work with you.
  2. We respect the diverse backgrounds, beliefs, gender identities, and experiences of our clients. We are committed to communicating effectively and respectfully, and we encourage you to discuss any cultural or personal factors that are important to your care.
  3. We do not tolerate racism, bias, or abusive behavior toward staff or other participants.
  1. Participation in any one offer or service by Co-Parenting Companion does not obligate clients to pursue further coaching services with Co-Parenting Companion. However, some programs may serve as a prerequisite for additional 1:1 or 1:2 coaching, as determined by Co-Parenting Companion.
  2. Your Co-Parenting Companion Practitioner will not make any decisions regarding the children’s parenting time with each parent or residential care.
  3. In the course of participating in the Co-Parenting Companion programs, issues may arise that, in the Practitioner's professional opinion, are beyond the scope of the coaching relationship. If this occurs, a participant may be advised to see their GP and obtain a referral to consult with an appropriate clinician.
  4. The Practitioner may, at any time and at their sole discretion, terminate a participant’s registration in any Co-Parenting Companion Program or Service if the Practitioner considers it appropriate to do so. In the event of termination of a participant’s enrollment in the Co-Parenting Companion program on this basis, a partial refund of the participant’s registration fees may be provided for any unused portion of service.
  1. Privacy

  1. Data Collection:  We collect personal information to support your coaching. This information is retained to document session details and to ensure the services offered to you are tailored and continuous. This is stored securely and accessed only by your Practitioner, subject to the exceptions in our Privacy Policy  (e.g., risk of harm, legal requirement).
  2. Personal Information  means your name, contact details, details of your health, and other pertinent information.
  3. You have the right to access the personal information we hold about you, subject to exceptions under relevant legislation. You can discuss with us the various ways this information can be accessed.
  4.  If we are lawfully required to make a disclosure without your consent, we will notify you of the nature and purpose of the disclosure.
  5. For a comprehensive explanation of how your information is managed, please refer to our Privacy Policy , available on our website. Our Privacy Policy outlines your rights to access and correct your personal information, as well as the process for lodging a complaint regarding our handling of your information. Your personal information will not be disclosed to overseas recipients unless you provide consent or such disclosure is required by law. Additionally, your information will not be used, sold, rented, or disclosed for any purpose other than those outlined in this agreement.
  1. Technology

  1. Electronic provision of services, including email, telephone, zoom and text messaging, may be provided by the Practitioner and Co-Parenting Companion staff. Scheduling is done by email, telephone and an online booking portal.
  2. You are responsible for ensuring you have a private space, without interruptions, a device with a camera/microphone (a computer or tablet is preferable to phone), and a stable internet connection.
  3. Co-Parenting Companion may use email to deliver some services to augment or follow up on coaching sessions. In these cases, we may provide updates, invoices, account statements, summaries, draft parenting plans or memos, educational resources or exchange information. Based on the nature of the service provided, these email communications may include information about you, your co-parent, and your children.
  4. Acknowledgement of Risk in Technology:

  1. When consenting to the provision of services by telephone or electronically, it is essential to appreciate both the risks and benefits, including insufficiency, misunderstandings due to lack of visual clues and context, and technological failures.
  2. All electronic communication (including email, video conferencing, and messaging) carries a privacy risk. While we use secure, encrypted platforms where possible, complete security cannot be guaranteed.
  3. In the event of a technology failure when using zoom for a once-off consult or as part of a  coaching package, your Co-parenting Practitioner will call you by telephone at the number you provide for backup at the time of scheduling.
  4. In the event of a technology failure when using zoom for Group Coaching, your Co-parenting Practitioner will provide you with a video recording of the Group Coaching call.
  5. You agree not to allow others (e.g., your children of any age, new partner, parent, friend, relative, etc.) access to any consultations, recordings, or communications sent to you from Co-Parenting Companion unless an agreement is reached in advance that the particular communication is appropriate to share with others.
  1. AI Recording:  You consent to Co-Parenting Companion recording conversations for the specific purpose of generating an AI-derived summary. The recording is deleted immediately after the summary is generated.
  2. All use of AI technology by Co-Parenting Companion is subject to our Artificial Intelligence Policy, available upon request.
  1. Fees & Payments

  1. Our fee structure and any potential costs for referrals or products will be discussed with you openly and transparently before services commence.
  2. Co-Parenting Companion may adjust all fees annually.
  3. Fees for packages and courses are generally payable in full at the time of booking/registration.
  4. Invoices:  If an invoice is issued, it is payable within 14 days.
  5. If you pay by bank transfer, you must:
  1. include the invoice number in the transfer detail; and,
  2. retain a copy of the bank transfer for your records.
  1. If the time to pay exceeds 14 days, then we may take any one of the following steps:
  1. cancel or postpone any scheduled appointments
  2. terminate the client agreement; and/or
  3. If you have not communicated with us, refer your matter to a third party for collection.
  1. You agree that we can provide your name, phone number and email address to a third-party collection agency for the purpose of collection of outstanding invoices.
  2. Refunds:  Fees are non-refundable except as required under Australian Consumer Law or as specified in the Cancellation Policy (Schedule 2). In exceptional circumstances, program credits or deferrals may be offered at Co-Parenting Companion's discretion.
  1. Intellectual Property

  1. All materials, videos, and handouts provided are the intellectual property of Co-Parenting Companion. You may not reproduce, distribute, commercially exploit or share these materials without our express written permission. Nor may you transmit it or store it on any other website or other forms of electronic retrieval system.
  2. Co-Parenting Companion expressly reserves all copyright and trademark in all documents, information and materials on our website and provided as part of the Co-Parenting Companion. We reserve the right to take action against you if you breach any of these terms.
  1. Feedback or Concerns

  1. We are committed to providing safe and effective care. If you believe our service has caused you harm, we encourage you to discuss this with us immediately so we can work to address your concerns. We are ethically obliged to report certain incidents to relevant authorities.
  2. If you raise a concern with us, we will:
  1. Provide information about complaints systems that are available;
  2. Where possible, work with you directly to resolve the issue;
  3. Consider whether the raising of the concern might adversely affect delivery of our services to you (noting in some cases, it might be advisable to refer you to another appropriate Practitioner).
  1. If you provide feedback in relation to an experience of harm our business will take the necessary steps to rectify the problem if possible.
  1.  Liability Waiver:

  1. Assumption of Risk:  Participation is at your own risk. Co-Parenting Companion is not liable for any direct or indirect loss or damage arising from your use of our services.
  2. We are not a crisis service. If you require urgent mental health support, please contact Lifeline (13 11 14) or your GP.

PART B: SERVICE SCHEDULE 

Please refer to the Schedule(s) relevant to the service you have selected or purchased.

SCHEDULE 1: Free Discovery Calls
  1. Parents are entitled to schedule and attend a free, no-obligation 15 minute “Clarity Call” (Co-Parenting Intensive Reset) or 30 minute “Discovery Call” (Coaching Packages) to determine if this is the right service for their needs.
  2. If you fail to attend a complimentary Discovery Call, any subsequent booking requests will incur a fee.
SCHEDULE 2: 1:1 and 1:2 Coaching (Private Sessions)
  1. Cancellation Policy:

  1. Notice of Cancellation:
  1. More than 72 hrs notice : You're welcome to reschedule your consultation
  2. 48-72 hrs notice : Your consultation can be rescheduled with a 50% rebooking fee
  3. Less than 48 hrs notice : Your consultation fee cannot be refunded or transferred independent of the reason for the cancellation
  1. If you're unwell:  For everyone's well-being, we can convert an in-person consultation to a Zoom session. We reserve the right to end in-person sessions if signs of illness are present, and fees cannot be refunded in these cases
  2. If you arrive late : you may still attend the balance of your appointment time. The Practitioner, in their sole discretion may choose to accommodate a late arrival.
  3. Whe re a participant cancels a pre-booked coaching session within the terms of the cancellation policy, the consultation must be re-booked befor e the end date of any purchased package (where applicable).
  4. Where coaching sessions are offered as part of a time-limited package, Co-Parenting Companion will not offer refunds for expired or unused 1:1 coaching sessions.
  5. For 1:2 Coaching Clients, the parents will each be responsible for bills arising from their own cancellation with insufficient notice or failure to attend a scheduled appointment.
  1. Termination of Private Coaching:

  1. You agree not to participate in adversarial litigation during the term of a 1:2 Coaching Package. If you initiate litigation, we may terminate the service.
  2. You may terminate your arrangement with Co-Parenting Companion with two weeks’ written notice. Where a package has been purchased, the unused portion of the package may be refunded at the discretion of Co-Parenting Companion.
  3. Participants cannot elect to attend 1:1 Coaching (except where specified above and with a transparent agreement with the co-parent as part of a 1:2 Coaching package) whilst they are engaged with 1:2 Coaching.
  1. Joint Clients (1:2 Coaching):

  1. The participants agree to undertake 1:2 Coaching as joint clients. As joint clients, the participants acknowledge:
  1. Records of or relating to joint sessions will be available or released to the participants or a third party only if both participants consent.
  2. Records of or relating to individual sessions will be available to the attending individual only.
  3. If at any stage the Practitioner does not consider the coaching can be provided in a safe or effective manner they may discontinue the Coaching.
  1. The participants acknowledge that the Practitioner may have mandatory reporting obligations in relation to factual circumstances that include abuse or neglect of a child, intention to commit a crime or terrorism related offences.
  2. The participants agree to participate in good faith.  The participants expressly agree that the records and material discussed within the participants’ coaching sessions are on a ‘without prejudice’ basis and information disclosed in coaching may not be used in a later court proceeding.
  3. The Practitioner will not proceed in a planned joint session with an absent party.
  4. The Practitioner adheres to a ‘no secrets’ policy in relation to disclosures made in individual sessions. This means the Practitioner may elect not to protect the secrets of one party if they determine that the secret undermines the agreed upon intention of the coaching. However, individual session records remain private to that individual unless agreed otherwise.
SCHEDULE 3: Group Programs & Membership
  1. Participation:
  1. All course learning is provided in the pre-recorded material in the student portal.
  2. Co-Parenting Intensive Reset & Compass Membership are group-based services; as such individual adjustments or alternative arrangements for live group call participation are not available.
  3. Participating in group coaching provides the opportunity to explore differing perspectives and receive support and feedback from other members in a confidential and safe environment. It can be highly effective for addressing interpersonal issues, reducing feelings of isolation, and practicing new behaviours.
  4. To protect privacy, you will never be placed in the same group, course or community as your own co-parent.
  5. You acknowledge that:
  1. Group coaching is entirely optional. If you elect to engage in group coaching, you are encouraged to participate at your own pace. You have the right to pass or decline to comment if you do not wish to speak.
  2. You may discontinue group coaching at any stage.
  3. The feedback and perspectives shared by other participants may not reflect the view of the Practitioner or necessarily be constructive.
  1. You agree to treat all group members and the Practitioner with respect. This includes listening without interrupting, giving constructive feedback, and refraining from verbal abuse, derogatory comments regarding any person present or not present, or harassment.
  1. Confidentiality:
  1. You acknowledge and agree:
  1. To keep strict confidentiality in respect of the names of other group members and all information they share within the group. What is said in the group, stays in the group.
  2. While other group members share reciprocal confidentiality obligations these are not enforceable against other participants.
  3. If at any stage, your Practitioner does not consider the coaching can be provided in a safe or effective manner they shall discontinue the coaching.
  4. You acknowledge that if any group member breaches your privacy outside the group or engages in defamatory or harmful conduct, Co-Parenting Companion is in no way responsible or liable for the actions of that group member, and you agree not to bring proceedings against Co-Parenting Companion in respect of any such conduct .
  5. Group recordings may be available to other members for a limited period. The time period will generally be four weeks, and the exact term will always be specified.
  1. Recordings:
  1. Live calls are recorded and made available on the LMS. You may view them but must not download  or distribute them.
  1. Fees:
  1. The Parenting Plan Course and Co-Parenting Intensive Reset are standalone programs with a fixed fee that is payable in full at the time of registration. Payment plans may be offered from time to time at the sole discretion of Co-Parenting Companion.
  2. Compass is a Membership program, with subscription details outlined below.
  3. Fees are inclusive of all live group coaching sessions, access to the online learning modules, and supporting materials as advertised.
  1. Membership
  1. Co-Parenting Companion Compass Membership is a paid subscription-based program that includes:
  1. online videos, tip sheets and downloadable resources,
  2. a private online community hub provided through a LMS student portal
  3. optional online group coaching calls.
  1. To ensure group safety and coherence, membership is generally only available to graduates of the Co-Parenting Intensive Reset Program.
  2. Members may be invited from time to time to participate in other Co-Parenting Companion coaching programs or offers. Participation in these programs is voluntary and may involve additional fees, which will be outlined to the participant before consent. Members are under no obligation or expectation to participate in any additional programs or offers.
  3. Live group coaching video calls (on zoom) provide the opportunity to problem-solve issues that multiple community members may be facing, maximising learning opportunities together whilst minimising financial outlay. Calls may include direct teaching, break-out rooms, and hot seat coaching (1:1 coaching in front of the group, only when the member has requested this opportunity). By consent, members may also choose to participate in roleplays and general discussion. These calls will be recorded and made available to all enrolled participants for a period of up to four weeks to view but not download. Co-Parenting Companion reserves the right to edit or withhold publication of recordings at its discretion .
  4. Members will receive the most benefit in the first 12 months, as this covers the key components of co-parenting skills and tasks across the calendar year. There are no lock-in contracts beyond the length of the subscription period currently paid.
  5. Optional 1:1 coaching sessions . These may be offered as an optional service for an additional specified fee that is discounted from the standard (non-member) rate.
  6. Subscriptions (Compass):
  1. Membership Subscription fees and inclusions are clearly stated at the time of registration.
  2. Subscription fees are subject to an annual review and may increase up to once every 12 months. Any rate increase will not be applied to existing, continuous members.
  3. By purchasing a Monthly Subscription, you agree to an initial pre-payment of one month of service. We will bill your credit card for the monthly subscription renewal fee on the monthly anniversary of your paid subscription until you cancel your subscription.
  4. You will be sent an automated request to update your credit card information when your card is close to expiring. Stripe manages this service, and their terms and conditions are listed on their website.
  5. If an automatic payment is declined or returned, we will make three further attempts to take payment. Upon the final decline, your subscription will be automatically cancelled.
  6. Cancellation : You may cancel at any time via the student portal. Access continues until the end of the current billing cycle. No partial refunds are provided for unused time.
  1. Co-parenting Companion will not provide a forum for members to meet outside of formal Co-Parenting Companion services. However, members may choose to make their own arrangements to meet outside of the program, and if so, this will have no relationship with Co-Parenting Companion.
SCHEDULE 4: Collaborative Law
  1. Tiffany Rochester may be engaged by co-parents as the Collaborative Coach to facilitate a Collaborative Separation. Collaborative Law is a formal, non-adversarial process of legal practice within a recognised legal framework. It requires legal representation by collaboratively trained lawyers, is underpinned by a legal contract (the Participation Agreement), and the agreed outcomes are legally binding and enforceable.
  2. The Collaboration will be deemed to commence when all participants have signed the Participation Agreement.
  3. Co-Parenting Companion shall charge fees for all professional services performed according to the terms of this Agreement, including administrative matters, phone calls, email correspondence and document review (where requested). All costs will be advised and agreed to in advance.
  4. In the event of a conflict between these Terms and the Participation Agreement, the Participation Agreement prevails.

PART C: CONSENT, WAIVER AND RELEASE

  1. Consent: By booking an appointment or purchasing a course or package, I acknowledge that:

  1. I have read and understood the General Terms (Part A) and the Schedule (Part B) relevant to my service.
  2. I agree to the Cancellation Policy and Privacy Policy.
  3. My consent is voluntary and ongoing. I may withdraw my consent at any point, and we will discuss the potential implications of doing so. My consent is provided for the period of my package, and my renewed consent will be sought for any further services or packages.
  4. I agree to inform your Co-parenting Practitioner of key matters that may affect coaching, including medical conditions, diagnoses, medications, or pregnancy.I agree to be bound by the Co-Parenting Companion Terms and Conditions.
  5. I have discussed any outstanding questions with Co-Parenting Companion.
  1. Waiver & Release: By booking an appointment or purchasing a course or package, I acknowledge and agree that:

  1. Participation is at my own risk;
  2. The service is not a psychological service, I am not receiving therapy at Co-Parenting Companion, and Co-Parenting Companion is not a substitute for individual psychological therapy, diagnosis or treatment.
  3. I will consult with my relevant health practitioner for a separate referral for mental health assessment and treatment if I need this in addition to Co-Parenting Companion products and services.
  4. I need to make my own enquiries to determine if the information or products are appropriate for my intended use;
  5. In no event will Co-Parenting Companion, or any of their staff, be liable for any loss or damage, including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising out of, or in connection with, the use of Co-Parenting Companion Coaching products and services.
  6. Through the Co-Parenting Companion website, products and services I may be able to link to other websites which are not under the control of Co-Parenting Companion. Co-Parenting Companion has no control over the nature, content and availability of those websites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
